1. FENEX conditions
All our activities and services are carried out under the Dutch Forwarding Conditions (Nederlandse Expeditievoorwaarden, the “FENEX conditions”), latest version, as filed by FENEX with the registries of the district courts in Amsterdam, Arnhem, Breda and Rotterdam. These conditions contain rules on, among other things, liability and its limits, payment and claims.
We send you a free copy on request: [email protected].
2. Prices on the website
Prices on the website are indicative. They are shown in the currency stated, exclude VAT and are valid for 30 days, unless stated otherwise. The binding price is the price in our written quote or booking confirmation. Prices are based on the information you give us; if that information turns out to be different, the price can change. If you book as a private person, our written quote and booking confirmation state the total price including VAT.
3. Quote and booking requests
A quote or booking request through the website is a request, not yet a contract. A contract is made when we confirm the booking in writing (by e-mail). Before you send a request, you confirm that you agree to these terms and the FENEX conditions and that you have read our privacy statement.
We may change these terms. With every request we record which version you accepted; that version applies to that booking.
4. Your information and documents
You make sure the information about your cargo (such as contents, weight, dimensions and dangerous goods) and the documents you provide are correct and complete.
5. Customer portal
Keep your login to yourself. To book through the website you confirm your e-mail address first. We may block access in case of misuse.
6. If you book as a private person
These terms and the FENEX conditions are written for business customers. If you book as a private person (a consumer), the following also applies. Nothing in these terms or in the FENEX conditions takes away the rights that consumer law gives you.
- Right of withdrawal. You may cancel a contract made at a distance (for example through our website or by e-mail) within 14 days after the day we confirm the booking, without giving a reason. Tell us clearly, for example by e-mail to [email protected]. You may use the form below, but you do not have to.
- If we start within those 14 days. If you ask us to start sooner (for example to secure space on a vessel or truck) and you then cancel, you pay a proportionate part of the price for what we have done until then. Once we have fully carried out the service at your request, you can no longer cancel.
- Refund. If you cancel, we refund what you paid, minus that proportionate part, within 14 days.
- Price. Our written quote and booking confirmation state the total price including VAT.
- Disputes. You may always bring a dispute before the court of the place where you live. If you live in another EU country, you also keep the protection of the mandatory consumer rules of that country.
